A good friend of mine who is a lawyer who does not handle person aggrieved cases referred his friend to us. It was a woman who has a place in the country, a nice summer cottage. They were in the process of loading up their vehicle here, in the town of Amherst in Erie County. They were going away for the weekend. She was putting in her different provisions and supplies that she would need for the weekend: different food, and suitcases, and things like that. She was kneeling on the part of the vehicle that opens and closes. You can actually kneel on this part of the vehicle, and it’s attached to the rest of the vehicle with cables.

As she is reaching in and she’s rearranging the back of her vehicle with the different cooking supplies, and luggage, and food, the cable snaps. Her arm is extended, and she sustains a very, very serious shoulder injury. Obviously, that weekend her plans were shot. She had to go to the hospital. She required surgery. She required physical therapy.

They argued well, this was her vehicle, she should have known about it, she should have had it inspected, and all these other arguments which were thrown up. At the end of the day, the fact is that when you handle what are called products cases and defective products, you really have to be able to hire the type of expert that you need to be able to come in and not only examine the product to see what was wrong with it but to also say why it was a defective automobile and why the manufacturer of that vehicle should have known about it, should have done something about it. They didn’t in this case.

With that type of evidence in hand, we were able to convince the manufacturer of that vehicle to pay her many hundreds of thousands of dollars for her recovery. She was an older woman. She did not make a good recovery from her shoulder surgery. Again, when no one can put Humpty Dumpty back together and make you the way you were, the hundreds of thousands of dollars that we were able to obtain for her certainly is a comfort for her to compensate her for her pain and suffering and to pay for any future medical expenses that she was going to have.
